United States Ninth Circuit

Bonivert v. City of Clarkston, 15-35292

Reversing the district court grant of summary judgment on qualified immunity grounds in a case where the plaintiff alleged a Fourth Amendment violation when police forced their way into his home without a warrant, tackled, tasered, and arrested him because a warrantless search is unreasonable when the defendant is physically present and expressly refuses consent to entry and none of the lawful exceptions to the warrant requirement are present.
