Vacating a district court's pre-discovery entry of summary judgment and remanding an action in which appellants challenged their exclusion from an enforcement zone set up around a Border Patrol checkpoint area near their homes in rural Arizona and holding that the district court's finding that the checkpoint was an enforcement zone and a nonpublic forum for the plaintiff's First Amendment activities and complaints was premature in occurring prior to appropriate discovery.
