United States Ninth Circuit

Arevalo v. Hennessy, 17-17545

Reversing a district court judgment that it was required to abstain from hearing a petition for a writ of habeas corpus challenging the conditions of pretrial detention in state court in the case of a man with no criminal priors who had his bail set at 1.5 million dollars that was lowered to 1 million after a hearing and a summary statement about the gravity of the charges because even if abstention had been merited under Younger it should have heard a case involving a showing of bad faith, harassment, or other extraordinary circumstances that would make abstention inappropriate.
