Earp v. Davis, 15-56989

Affirming the district court's order on remand denying the merits of a state prisoner's habeas corpus claims that the state court improperly denied a motion for a new trial based on prosecutorial misconduct because allegations of spoilated evidence and witness intimidation was too attenuated and the district court did not clearly err in its decision.
