Reversing a conviction for transporting an illegal alien for financial gain, rejecting the government's contention that the defendant failed to preserve an error in the district court's jury instruction defining 'reckless disregard' and holding that the admission of a passenger's videotaped deposition violated the Confrontation Clause because the government failed to show that the passenger was unavailable, or that their efforts to secure his presence were reasonable.
