Granting the petition for review of a Board of Immigration Appeals' decision and finding abuses of discretion in the Immigration Judge's failure to recognize that the medical record relied upon in a competence determination was nearly a year old and in their departure from Board standards set for competency determinations, particularly since the individual in question was a detainee and they necessarily possessed, but did not introduce, more recent medical records.
