Rejecting the contention that the government failed to establish jurisdiction under the Clean Water Act in the case of the conviction of a man responsible for dirtying the water in a national forest in the course of his mining operations because the facts satisfied the 'significant nexus' test, the term 'waters of the United States' was not vague, decisions relating to the admission of evidence and testimony were not an abuse of discretion, and holding that a criminal defendant cannot challenge the sufficiency of evidence at a previous trial following conviction at a subsequent trial.
