United States Ninth Circuit

US v. Jayavarman, 16-30082

Affirming a conviction for the attempt to produce and transport into the United States a visual depiction of a minor engaged in sexually explicit conduct, but vacating a conviction for attempt to aid and abet travel with intent to engage in illicit sexual conduct and vacating the sentence as to both counts because the law did not permit aiding and abetting offenses but sexually explicit images produced with the belief that the subject is a minor triggers criminal liability, even where the individual is not actually a minor.
