United States Ninth Circuit

US v. Barragan, 13-50516

Affirming the convictions of three defendants but vacating and remanding for resentencing the fourth in a Racketeer Influenced and Corrupt Organizations Act (RICO) prosecution where part of a prosecutor's closing argument involved inviting the jury to 'send a message' with its conviction, but did not amount to prejudice but one of the convictions mistakenly applied a career offender enhancement where the defendant's prior was not for a crime of violence or controlled substance offense.
