United States Ninth Circuit
Rubenstein v. Doe No. 1, 234269
Reversing a decision by the Court of Appeal that a claim filed in 2012 alleging sexual molestation of the plaintiff by a high school cross-country and track coach from 1993-1994 that resurfaced in 2012 as latent memories was timely and not barred under statutes of limitations because the filing of a timely claim as required in actions against public entities is a non-statute of limitations bar to suit and various tolling statutes did not cause the claim to re-accrue in the years following the alleged molestation.
