United States Ninth Circuit

Saleh v. Bush, 15-15098

In a suit alleging that former officials of the President George W. Bush administration engaged in the war against Iraq in violation of the Alien Tort Statute, in which the court, pursuant to the Westfall Act, substituted former officials of the President George W. Bush administration for the United States as the sole defendant, the district court's dismissal of the action is affirmed where plaintiff failed to exhaust her administrative remedies.
