United States Ninth Circuit

Visciotti v. Martell, 11-99008

Denial of habeas corpus relief to California state prisoner is affirmed where: 1) whether or not the ineffective assistance of counsel claims have merit, they are foreclosed by the Supreme Court's prior decision in this case, Woodford v. Visciotti, 537 U.S. 19 (2002); and 2) counsel's failure to object to the closure of death-qualification voir dire did not constitute deficient performance, and petitioner therefore cannot demonstrate cause to excuse his default of the public trial right claim.
