United States Ninth Circuit

US v. Nixon, 16-50097

The district court's denial of a motion for modification of the conditions of probation is affirmed where a congressional appropriations rider that prohibits the Department of Justice from using certain funds to prosecute individuals for engaging in conduct permitted by state medical marijuana laws does not impact the ability of a federal district court to restrict the use of medical marijuana as a condition of probation.
