United States Ninth Circuit

McDaniels v. Kirkland, 09-17339

Denial of habeas relief to two California state prisoners, who contended that the California Court of Appeal's adjudication of their Batson claims was based on an unreasonable determination of the facts, is affirmed on remand from the en banc court where, after considering juror questionnaires and the transcript of the first day of voir dire which the petitioners failed to provide to the California Court of Appeal, the California Court of Appeal's adjudication of their Batson claims did not rest on an unreasonable determination of the facts.
