Draper v. Rosario, 14-16340

In an action brought pursuant to 42 U.S.C. section 1983 by a California state prisoner, alleging violations of his Eight Amendment right to be free from cruel and unusual punishment stemming from a physical altercation with a prison officer, the District Court's judgment is: 1) affirmed as to the dismissal of his due process claim; 2) affirmed as to evidentiary rulings; and 3) vacated as to the award of costs in favor of defendants.
