In a criminal prosecution for charges of conspiracy to distribute cocaine, the district court's order denying the defendant's motion to suppress evidence derived from the use of wiretaps is vacated where the record does not show exactly when agents knew or should have known that the phone conversations did not involve the persons involved in the target conspiracy, and remanded to determine what evidence was lawfully obtained in 'plain hearing.'
