Godoy v. Spearman, 13-56024

In a habeas corpus action, challenging petitioner's conviction for second-degree murder on the grounds that a juror allegedly conferred via text message with a 'judge up north' during the trial, the district court's denial of the petition is affirmed where the California Court of Appeal's did not unreasonably apply clearly established federal law in concluding that the government had rebutted the presumption of prejudice arising from alleged juror misconduct.
