In an immigration action, the petition challenging the Board of Immigration Appeals' decision finding petitioner ineligible for adjustment of status or cancellation of removal is denied where the expungement of petitioner's California conviction for being under the influence of methamphetamine does not prevent use of the conviction for the purposes of eligibility for adjustment and cancellation under 8 U.S.C. section 1101(a)(48).
