Sentence and conviction by guilty plea to unlawful possession of a handgun in violation of 18 U.S.C. section 922(g)(1) is: 1) affirmed as to conviction where the District Court did not clearly err in dismissing defendant's motion to suppress evidence; but 2) vacated as to sentence where the government conceded the unconstitutionality of section 2K2.1(a)(2) of the U.S. Sentencing Guidelines.
