In a suit brought against a union under the Americans with Disabilities Act (ADA) alleging disability discrimination and retaliation claims, the district court's dismissal is reversed where: 1) the ADA claims were not barred by issue preclusion; and 2) the ADA complaint was not barred by claim preclusion.
