United States Ninth Circuit

Orona v. US, 16-70568

In a case published to clarify an issue regarding the running of the statute of limitations concerning the 1-year period of limitation under 28 U.S.C. section 2255, that period begins to run from the latest of four different events, and the one applicable in this case is 'the date on which the right asserted was initially recognized by the Supreme Court, if that right has been newly recognized by the Supreme Court and made retroactively applicable to cases on collateral review.' Here that date is the date the Supreme Court decided Johnson v. US, 135 S. Ct. 2551 (2015).
