Runningeagle v. Ryan, 07-99026

Denial of a petition for writ of habeas corpus relief from death sentence for conviction of first degree murder is affirmed over petitioner's claim of ineffective assistance of counsel where on limited remand, in light of Martinez v. Ryan, 132 S. Ct. 1309 (2012), which announced a new equitable rule allowing a petitioner to show cause for the procedural default of certain ineffective assistance claims, petitioner did not show cause under Martinez, and thus did not excuse the procedural default.
