N. County Communications Corp. of Arizona v. Qwest Corp., 14-15115
In actions brought under the Telecommunications Act of 1996 by local exchange carriers that provide telecommunications services to their customers in Arizona and Oregon, two District Courts' summary judgments in favor of Qwest Corporation and two state regulatory commissions are affirmed where: 1) the Commissions had authority to arbitrate the 2011 interconnection agreements (ICA); 2) none of the provisions subject to review violates the Telecommunications Act or its implementing regulations; and 3) none of the state Commissions' actions were arbitrary or capricious.
