United States Ninth Circuit

Oklevueha Native Am. Church v. Lynch, 14-15143

In a civil rights action, the district court's grant of summary judgment to the federal government is affirmed where: 1) plaintiffs failed to prove that federal prohibitions on possessing and distributing cannabis are a "substantial burden" on their free exercise of religion under the Religious Freedom Restoration Act; and 2) the American Indian Religious Freedom Act does not create a cause of action or judicially enforceable individual right.
