Thomas v. Dillard, 13-55889

In a civil rights action, arising after defendant police officer tased plaintiff while responding to a possible domestic violence call, the district court's grant of summary judgment to plaintiff and denial of qualified immunity to defendant police officer is reversed where defendant officer lacked reasonable suspicion to detain plaintiff to perform a Terry frisk, violating his Fourth Amendment rights, but such right was not clearly established at the time.
