United States Ninth Circuit

US v. Alexander, 14-50576

In a criminal action, the district court's denial of defendant's motion to dismiss his indictment citing his constitutional right to a speedy trial is affirmed where: 1) the five-year delay in extraditing defendant from Canada was sufficient to trigger an inquiry under Barker v. Wingo, 407 U.S. 514 (1972); 2) the balance of factors under the Barker analysis weigh against defendant.
