Avenue 6E Investments v. City of Yuma, 13-16159

In a housing discrimination action brought by two real estate developers against defendant city, contending that the defendant's refusal to rezone land to permit higher-density development stemmed from discrimination against Hispanics, the district court's grant of summary judgment to defendant is reversed where: 1) plaintiffs presented plausible claims for relief for disparate treatment under the Fair Housing Act and the Equal Protection Clause sufficient to pass the plausibility bar; and: 2) the district court's view that that availability of other similarly-priced and similarly-modelled housing elsewhere precluded a disparate impact finding was erroneous.
