State of Alaska Dep’t of Nat. Res. v. US, 14-35051

In a property action, concerning the state of Alaska's claim to four rights-of-way on defendants' property, obtained under the federal Alaska Native Allotment Act, the district court’s dismissal of the state's suit is affirmed in part and vacated in part where: 1) the United States has not waived sovereign immunity from suit pursuant to the Quiet Title Act's Indian lands exception; but 2) Congress waived the United States’ immunity from suit with respect to condemnation claims under 25 U.S.C. section 357.
