In a property law and real estate class action, alleging that defendants failed to make certain disclosures while selling non-residential condominium units in San Diego’s Hard Rock Hotel & Condominium Project, in violation of the Interstate Land Sales Full Disclosure Act (ILSA), 15 U.S.C. section 1701 et seq., the district court's grant of partial summary judgment to plaintiffs is affirmed where ILSA applies to plaintiffs claims and ILSA's disclosure requirements apply to the condo purchases at issue here.
