In a consumer protection action, alleging that defendant corporation failed to adequately disclose a negative option in the terms and conditions appearing on the landing page of its website, in violation of section 5(s) of the Federal Trade Commission (FTC) Act, the district court’s $18.2 million restitution award against the defendant corporation's CEO is: 1) vacated for the district court to specify whether defendant CEO is held jointly and severally liable; and 2) affirmed in so far that the district court properly calculated the restitution award under section 13(b) of the FTC Act.
