Idaho Wool Growers Ass’n v. Vilsack, 14-35445
In an environmental action challenging the EPA's closure of 70% of the Payette National Forest's grazing allotments to domestic sheep in order to protect the bighorn sheep population, the district court's grant of summary judgment to defendant is affirmed where the U.S. Forest Service's failure to consult the Agricultural Research Service was harmless error and the agency's actions were not otherwise arbitrary, capricious, or an abuse of discretion.
