Arizona ex rel. Darwin v. EPA, 13-70366

In an environmental action, challenging the EPA’s partial disapproval of Arizona’s State Implementation Plan (SIP) for reducing haze and the implementation of a Federal Implementation Plan (FIP) in its place, the petitions for review are denied where: 1) the EPA did not act arbitrarily and capriciously in disapproving the SIP’s best available retrofit technology’ proposals for the coal-fueled Coronado Generating Station; and 2) the EPA did not err procedurally in promulgating the FIP.
