Mena v. Long, 14-55102

In a habeas corpus action, the district court's denial of petitioner's request for a stay-and-abeyance to pursue unexhausted claims for relief is reversed. The court held that the stay-and-abeyance procedure for mixed petitions approved of in Rhine v. Weber, 544, U.S. 269 (2005), can apply to petitions raising only unexhausted claims for relief.
