United States Ninth Circuit

Taylor v. Beard, 11-55247

Conviction and sentence for aiding and abetting murder is affirmed where petitioner's original life without parole sentence was revised after the state determined he was not the actual shooter at the scene. The en banc Court held that the revising petitioner's sentence under the aiding and abetting theory was not inconsistent with the jury's original verdict and did not require setting aside his conviction.
