US v. James, 13-10543

In a criminal action following defendant's conviction for two counts of sexual abuse of a severely disabled woman, in violation of 18 U.S.C. section 2242(2)(B), the district court's entry of judgment of acquittal is reversed where there was sufficient evidence to support the jury's determination that the victim was physically incapable of resisting or refusing sex with defendant.
