In an immigration action, the petition challenging the Board of Immigration Appeals (BIA)'s denial of petitioner's application for asylum is denied where: 1) the court has jurisdiction after the BIA remanded the case to the immigration judge solely for proceedings related to voluntary departure; 2) the court lacks jurisdiction over petitioner's asylum claim because it was not exhausted before the BIA; and 3) petitioner's removal proceedings did not violate his due process rights.
