In a subpoena compliance appeal, arising from an investigation into alleged false statements by defendants' attorneys to the FDA during the agency investigation of the safety risks of the LapBand, the district court's order to compel production is vacated and remanded where the court failed to conduct an in camera review of the subpoenaed documents to determine which documents within the crime-fraud exception to the attorney-client privilege.
