US v. Navarrette-Aguilar, 14-30056
Conviction for conspiracy to distribute heroin, distribution of heroin, and possession of heroin is reversed in part and affirmed in part where: 1) the jury's special finding that defendant possessed one kilogram of heroin was not supported by evidence and the case must be remanded for resentencing; and 2) the district court properly permitted the prosecution to ask a defense witness about defendant's prior convictions for drug trafficking where the witness opened the door to impeachment.
