McDaniels v. Kirkland, 09-17339

In a habeas corpus case, the en banc court held that: 1) federal courts may consider the entire state-court record, including evidence presented only to the trial court, when hearing federal habeas corpus cases; 2) the California Court of Appeal's adjudication of petitioner's Batson claims was not contrary to or an unreasonable application of clearly established federal law under 28 U.S.C. section 2254(d)(1); and 3) the case be remanded to the three-judge panel for a determination on whether the California Court of Appeal's decision was based on an unreasonable determination of the facts under 28 U.S.C. section 2254(d)(2).
