United States Ninth Circuit

Viloria v. Lynch, 11-73725

In an immigration action, the court dismissed the petition for review of a Board of Immigration Appeals decision that petitioner had not met his burden of proving derivative citizenship. The court held that the lack of a final order of removal deprived it of appellate jurisdiction under 8 U.S.C. section 1252(b)(9).
