Mondaca-Vega v. Lynch, 03-71369

In an immigration action, the court denied the petition for review alleging that petitioner is a U.S. citizen and held: 1) that the district court correctly concluded that the "clear, unequivocal, and convincing" standard of proof used in alienage-determination proceedings is the same standard of proof used in civil cases involving important individual interests; and 2) F.R.C.P. Rule 52(a)'s clear error standard applies to appellate review of the district court's findings of fact in nationality determinations.
