Sjurset v. Button, 13-35851

In a 42 U.S.C. section 1983 action, arising after Oregon Department of Human Services (DHS) officials, with the help of defendant police officers, took plaintiff's children into protective custody without a court order, the district court's denial of qualified immunity to the police officers is reversed where DHS officials made the protective-custody determination and the officers did not violate clearly established law.
