United States Ninth Circuit
Lyall v. City of Los Angeles, 13-56122
In a 42 U.S.C. section 1983 action arising after a police entry, search, and seizure at a musical event held in an L.A. warehouse, the district court's judgment for defendants is affirmed in part and reversed in part where: 1) most plaintiffs who merely attended the event lacked standing on the warrantless entry claim while plaintiff Cortez's unreasonable seizure claim is procedurally barred; but 2) plaintiffs Cortez and Lopez have standing on their warrantless entry claims because they were in possession of the warehouse at the time.
