United States Ninth Circuit
Cascadia Wildlands v. Thrailkill, 14-35819
In an environmental action, the district court's denial of plaintiff environmental groups' motion to enjoin the Douglas Fire Complex Recovery Project in Oregon's Klamath Mountains in order to save the Northern Spotted Owl and its habitat is affirmed where plaintiffs failed to show a likelihood of success on the merits by demonstrating that the U.S. Fish and Wildlife Service's biological opinion supporting the project was arbitrary and capricious.
