Rios v. Lynch, 12-72551
In an immigration action seeking withholding of removal on the grounds that petitioner is a persecuted member of a social group in his home county of Guatemala, as an Evangelical and a member of a family targeted by gangs, the petition is granted in part and reversed in part where: 1) substantial evidence supported the Board of Immigration Appeals (BIA) decision that petitioner was never threatened or harmed due to his religious affiliation; and 2) the BIA erred by not addressing petitioner's argument that his family constituted a social group under the immigration laws.
