In a civil rights action, the district court's dismissal of the plaintiff's complaint is reversed where plaintiff's First Amended Complaint, filed under a stipulation between the parties, was not filed as a matter of course under F.R.C.P. Rule 15(a) and that plaintiff's Second Amended Complaint could be filed as a matter of course.
