United States Ninth Circuit

US v. Galan, 14-30145

In a criminal appeal, the district court's restitution order directing defendant, convicted of distributing and possessing child pornography in violation of 18 U.S.C. section 2259(a), to cover losses to a victim is vacated where the losses caused by the original abuse of the victim should be disaggregated from the losses caused by the ongoing distribution and possession of images of that original abuse.
