Mancilla-Delafuente v. Lynch, 12-73469

In an immigration action challenging petitioner's removal order, the Board of Immigration Appeals decision that petitioner was ineligible for cancellation of removal is affirmed where: 1) petitioner's conviction for conspiracy to possess a credit card without the consent of the cardholder, in violation on Nev. Rev. Stat sections 199.480 and 205.690(2), constitutes a crime of moral turpitude under 8 U.S.C. section 1229b(b); and 2) petitioner is ineligible for the petty offense exception because the offense was punishable by up to a year imprisonment at the time of his conviction.
