Pauma v. California, 14-56104
In an action brought by the Pauma Band of Luiseno Mission Indians against California for misrepresenting the number of gaming licenses available under the Tribal-State Gaming Compacts, the district court's grant of plaintiff's motion for summary judgment is affirmed where: 1) the court's prior interpretation of the Compacts' license pool provision applies retroactively; 2) the district court's $36.2 million rescission and restitution award was a proper remedy; and 3) California waived its sovereign immunity under the Eleventh Amendment.
