Zumel v. Lynch, 12-70724

In an action challenging a Board of Immigration Appeals (BIA) decision that plaintiff was inadmissible for entry under 8 U.S.C. section 1182(a)(3)(B)(i)(I) for engaging in terrorist activity, based on his participation in a series of coups in the Philippines in the 1980s, plaintiff's petition for review is granted where the BIA failed to use the clear error standard when reviewing the Immigration Judge's findings as to the plaintiff's intent to endanger the safety of individuals.
